A DePuy ASR MDL status conference was held on Tuesday, November 22, 2011 before the Honorable David Katz, the judge overseeing the federal multidistrict litigation against DePuy Orthopaedics, Inc. and Johnson & Johnson regarding the recalled DePuy Orthopaedics ASR hip replacement devices. Judge Katz granted Plaintiffs’ Motion for a Common Benefit Fund. That order was entered on November 28, 2011 as Case Management Order No. 13.
During the hearing, it was noted that as of November 22, 2011 at 10:30 a.m., there had been 2,834 cases filed in the federal MDL. It was also noted that there were approximately 176 DePuy ASR cases filed in New Jersey state courts and approximately 1,100 DePuy ASR cases filed in California state courts.
Plaintiffs’ oral request for an extension on the Plaintiff Fact Sheet deadline was granted. Plaintiff Fact Sheets are now due on January 10, 2012. Judge Katz also set the next status conference for the DePuy ASR MDL litigation for January 23, 2012 at the federal courthouse in West Palm Beach, Florida.
