Were you a victim of a wrong surgery?
FORT WORTH, Texas, September 21, 2017/PRNewswire/ – Bernice Marie Gomez filed suit against Sujeet Acharya, Texas Oncology, P.A. and Texas Urology Associates in the 160th District Court in and for Dallas County, Texas, Case Number DC-17-12969 on September 20, 2017. The lawsuit alleges that a Texas Oncology surgeon, Sujeet Acharya, performed the wrong procedure on Ms. Gomez – removing almost half of her pancreas rather than removing a malignant tumor on her left adrenal gland.
In July, 2016, Bernice Gomez was diagnosed with neuroendocrine carcinoma. She was advised that she had malignant tumors on her left and right adrenal glands. Surgery was scheduled for November 14, 2016 to remove the left adrenal gland and tumor at Methodist Dallas Medical Center. The surgery was performed using the da Vinci Robotic System ® manufactured by Intuitive Surgical, Inc. (ISRG) Following the surgery, Ms. Gomez’ family was advised that the surgery was successful and the tumor had been removed. Ms. Gomez later learned that the malignant tumor had not been removed and that instead, 40% of her pancreas had been removed during the operation. The pancreas was cancer free. She was unable to have any treatment for her cancer for months because of the serious injury to her pancreas. Ms. Gomez is a mother of three daughters, ten grandchildren and three great grandchildren, who lives in Alvarado, Texas. She is now unable to work, but had worked for 26 years in healthcare.
Ms. Gomez seeks compensation for her injuries caused by the failed surgical procedure. ”What happened to Ms. Gomez is shocking”, said attorney John David Hart of the Law Offices of John David Hart in Fort Worth, Texas. “It is almost unbelievable that a surgeon would remove part of the wrong organ for a cancer patient.
