December Trial Off as Nevada Plaintiffs ‘Resolve’ DePuy ASR Claims

On August 7, 2012, HarrisMartin published an article regarding the recent resolution of three separate Plaintiffs’ claims against DePuy Orthopaedics, Inc. regarding the ASR hip device. A December 3, 2012 trial date had been set for these three Plaintiffs in a Nevada state court. They could have potentially been the first ASR hip cases to go to trial.

The three Plaintiffs, Martha Bender, Katherine Guy, and Anneliese Rundle, asserted numerous causes of actions in their complaint against DePuy Orthopaedics, Inc. and against Precision Orthopaedics, Inc., a Nevada distributor of the ASR hip devices. These causes of action included strict liability, negligence, deceptive trade practices, failure to warn, and concealment of risk.

The exact details regarding the resolution and the settlement amount of these three claims were not disclosed by either side in the litigation. The resolution of claims brought by the three Plaintiffs was noted in the June 27th minutes of a meeting with the judge overseeing the cases. The cases were to be tried in Clark County District Court.
