Stryker Rejuvenate and ABG II Cases Selected for Early Mediation

A case management conference was conducted on August 13, 2013 before the Honorable Brian Martinotti, the Judge presiding over the litigation pending in the Superior Court of New Jersey in Bergen County against Howmedica Osteonics Corporation d/b/a Stryker Orthopaedics regarding the recalled Rejuvenate and ABG II Total Hip Systems.

An overview of the status of the litigation was presented at the conference.  Orders were recently entered relating to service of process and treatment of confidential documents.  According to Case Management Order #8, the parties have conferred and agreed to schedule several cases for early mediation.  The Court randomly selected six cases and the Plaintiffs’ Liaison Counsel selected an additional two cases for early mediation.  Stryker has thirty days to select an additional two cases.  Mediation sessions are ordered to take place no later than December 15, 2013.

The next status conference is scheduled on September 24, 2013 at 10:30 a.m.  The parties are to meet and confer prior to the conference to discuss selection of cases for a second phase of mediation.
