Eight lawsuits filed against DePuy and J&J regarding recalled hip devices
FORT WORTH, TEXAS—Eight cases were filed yesterday by the Law Offices of John David Hart on behalf of plaintiffs whose DePuy ASR Acetabular Hip Replacement Systems have been recalled. The cases were filed on behalf of Linda Sue and Richard Hall, Holt and Suzanne Atherton, Donald and Kay David, Arthur and Constantina Angelo, Doris Campbell, Marjorie Whittemore, Darshita and Rashmikant Bhakta and Daniel Weinberger against DePuy Orthopaedics, Inc., DePuy Inc., DePuy International, Ltd., Johnson & Johnson, Inc., Johnson & Johnson Services, Inc. and Johnson & Johnson International, Inc. in the United States District Court for the Northern District of Ohio. John David Hart is the attorney representing each of these plaintiffs.
DePuy Orthopaedics, Inc., a division of Johnson and Johnson, Inc., recalled its ASR Metal-on-Metal Hip Replacement Systems on August 24, 2010. DePuy identified reasons for the failure of the devices as component loosening, malalignment, infection, fracture of the bone, dislocation, metal sensitivity and pain. The DePuy ASR has also been associated with increased metal ion levels in the blood. Recent information published by the British Orthopaedic Association indicated that failure rates at six years may be as high as 49%.
“The number of people affected by this unsafe device continues to grow,” said attorney John David Hart. “According to recent studies, the failure rate of the DePuy ASR increases as the device ages. Unfortunately, many patients will experience failure of their ASR device in the future. Each state has specific statutes of limitations defining the time periods for filing these types of cases. These deadlines are extremely important. All patients with an ASR device should seek legal advice regarding the applicable statute of limitations and their individual claims to ensure that their legal rights are protected.”
