The first DePuy ASR bellwether trial was scheduled to begin on September 9th in the consolidated federal multi-district litigation (“MDL”) before Judge David Katz in Toledo, Ohio. The trial was adjourned for two weeks and reset on September 24, 2013. Judge Katz issued an Order last Friday to set aside the September 24, 2013 trial date and indicated that the trial will be reset to commence within the next 90 days. The Order noted scheduling and pretrial discovery issues as the reason for the continuance. The Order also noted that the additional depositions and pretrial discovery are necessary for the thorough preparation and presentation of this bellwether case.
