Multi-million Dollar Settlement Reached in Fatal Easter Sunday Truck Crash

FORT WORTH – John David Hart of The Law Offices of John David Hart of Fort Worth and Dan Boulware of MacLean & Boulware have negotiated a settlement of the lawsuit resulting from an 18-wheeler truck crash on Easter Sunday, 2007. The defendants agreed to pay $5.1 million to settle the case. On April 8, 2007, 50-year-old Penny Sue Thompson was driving a vehicle with her two grandchildren, Aubrey Nicole Moore, 6, and Dylan Glenn Moore, 10. Larry Dean Roberts, 53, was driving a tractor-trailer. According to police reports, the two vehicles collided when Roberts failed to stop at a stop sign. As a result, both Aubrey Moore and Penny Thompson died; Dylan Moore was severely injured.

Mr. Hart and Mr. Boulware represented the children’s parents Corey and Lisa Moore of Cleburne, Texas, in a wrongful death and serious injury lawsuit against Joe Swinson of Swinson Excavating, Stoney Point Agricorp., Inc., and truck driver Roberts. Of the $5.1 million settlement, $425,000 was paid to other family members of Penny Sue Thompson who intervened in the lawsuit.

Roberts told police investigators that he had been in a hurry and was talking to his dog when the crash occurred. Plaintiffs charged that the negligence of Roberts caused the crash that killed Aubrey Moore and Penny Thompson, and the severe injuries to Dylan Moore.
