Easter Sunday Truck Crash Prompts Lawsuit
Police say tractor-trailer had faulty brakes and driver was distracted

CLEBURNE - A Cleburne couple has filed a lawsuit against a tractor-trailer driver and his employer, charging that their negligence caused an Easter evening truck crash that killed their young daughter, seriously injured their son and also killed the children's grandmother.

According to police reports, 53-year-old truck driver Larry Dean Roberts drove through a stop sign at the intersection of Texas 171 and Farm Road 916 in Johnson County and collided with a pickup truck carrying the two children.

The pickup was driven by the children's grandmother, Penny Sue Thompson of Itasca, Texas. Aubrey Nicole Moore, 6, and Ms. Thomas, 50, died from injuries they received in the crash. Dylan Glenn Moore, 10, was seriously injured and remains in a coma in an intensive care unit at a Fort Worth hospital.

Mr. Roberts, a Commerce, Texas, resident, told police investigators that he had been in a hurry and was talking to his dog when the crash occurred. Investigators also found that the truck Mr. Roberts' was driving, owned by Swinson Excavating of Commerce, Texas, had four brakes that were out of adjustment.

The children's parents, Dylan and Ms. Thompson's family are going through a terrible tragedy, made even worse because it could have been prevented, said attorney John David Hart of the Law Offices of John David Hart in Fort Worth.

"Trucking companies have a duty to make sure their employees are driving safely,'' Mr. Hart said. "All of us rely on them to follow basic traffic laws. This did not have to happen.''

The lawsuit was filed in Johnson County by the two children's parents, Corey and Lisa Moore, and charges that the negligence of Mr. Roberts and his employer, Swinson Excavating of Commerce, Texas, caused the crash. The lawsuit seeks unspecified expenses and damages related to the deaths of Aubrey Nicole Moore and Penny Sue Thompson and expenses and damages stemming from Dylan Glenn Moore's injuries.
